1. Acceptance of Terms

By using the BUSCA PEÇAS application, developed by ProjetoX, you agree to comply with and be subject to these Terms of Use. If you do not agree to these terms, please do not use the app. Continued use of the application following any change to these terms will be deemed acceptance of the modifications.

2. Eligibility

To use BUSCA PEÇAS, you must be at least 18 years old or older, or have the consent of a legal guardian. By using the application, you declare that you comply with this requirement.

3. License to Use

We grant you a limited, non-exclusive, non-transferable license to use the application in accordance with these Terms of Use. This license does not grant you any intellectual property rights in the application or its contents.

4. Intellectual Property Rights

You acknowledge that all intellectual property rights, including, but not limited to, patents, copyrights, and trademarks, in relation to the application and its contents, belong exclusively to ProjetoX. No right, title, or interest in and to the application is transferred to you.

5. Permitted Use

You agree to use the application only for the purposes permitted by these Terms of Use and in accordance with all applicable laws and regulations. You must not:

• Use the application for any illegal or unauthorized purpose;
• Interfere with or disrupt the operation of the Application or the servers and networks connected to the Application;
• Attempting to access restricted areas of the app or obtaining data without authorization;
• Use any form of automation (e.g., bots, scripts) to access or use the application.

5.1. Definitions

• Bots: Computer programs that perform automated tasks repeatedly.
• Scripts: Sequences of instructions or code that automate tasks within a system.

5.2. Examples of Prohibited Use

In addition to the above prohibitions, the following activities are strictly prohibited and may result in suspension or termination of your account:

• Attempt to hack or breach the security of the application's system, including using any method to circumvent system protections;
• Use data or information obtained illegally or without proper authorization;
• Upload malicious content, such as viruses, malware, or any other technology that may cause damage to the app or other users' devices;
• Monitor, track, or collect personal information of other users without their express consent or in accordance with applicable laws.

6. Limitation of Use

You agree not to use the App in any manner that could impair or compromise the functionality of the App or interfere with the experience of other users. Any abusive or improper use of the app may result in suspension or termination of your access.

7.1. Ownership of Content

You retain all rights to the content you post or submit through the app. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, display, and distribute such content for purposes related to the operation and promotion of the application.

7.2. Responsibility for Content

You are solely responsible for the content you post or submit through the app. We are not responsible for any content submitted by users.

7.3. Removal of Inappropriate Content

ProjetoX reserves the right to review, moderate, or remove any content submitted by you that, in our sole discretion, is deemed inappropriate, offensive, illegal, or in violation of these Terms of Use. This includes, but is not limited to:

• Content that incites hatred, discrimination, violence, or harassment;
• Content that infringes on the rights of others, such as copyright, trademarks, or privacy;
• False, misleading, or fraudulent information;
• Material that is considered offensive, abusive, obscene, or in bad faith.

Any content that violates these terms may be removed without notice, and, depending on the severity, may result in the suspension or termination of your account.

8. Third-Party Services

The BUSCA PEÇAS application uses third-party services to ensure its operation. By using the application, you also agree to the Terms of Use and Privacy Policy of these services, such as Google Play Services. You can access the Terms of Use for these services at the links below:

The BUSCA PEÇAS application may use other third-party services that provide essential information for the operation, including accommodation providers, CNPJ consultation, location with latitude and longitude, ZIP code consultation, SMS sending and lists of states and cities of the IBGE. Some of these third-party services do not provide their own Terms of Use or Privacy Policy. In this case, we ensure that the use of this data respects our own Privacy Policy and is done solely to offer you a better experience in the app.

Any issues arising from the operation of these services are the responsibility of each provider, where applicable, and are subject to our own Privacy Policy to ensure the security of your data.

9. Privacy

Your use of the app is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the General Data Protection Law (LGPD).

This can make your device vulnerable to malware and compromise the security of the BUSCA PEÇAS application, in addition to affecting its proper functioning.

13.1. User's Responsibility

The user will be solely responsible for any loss of data, damage or injury resulting from jailbreaking or rooting their device, or for otherwise compromising the security of the device.

14. Data Backup and Restore

ProjetoX implements backup routines to ensure data security. However, we do not guarantee full data restoration in the event of technical failures or accidental deletion by the user.

15. Data Deletion and Re-registration

By requesting the deletion of the account, the user will lose access to all data and services associated with the account, and it will not be possible to retrieve information later.

15.1. Deletion Request

You have the right to request the deletion of your personal data from our databases at any time. Upon request, we will take the necessary steps to permanently delete your information, except in situations provided by law.

15.2. Maintenance of Minimum Information to Prevent Re-registration

To ensure the security and integrity of our system, after the deletion of your personal data, we will keep a minimum record (such as email address and phone number), in encrypted form and in compliance with applicable data protection laws. This registration will be used solely to prevent users who requested deletion from being able to re-register improperly, ensuring that their rights are respected without leaving room for abuse. The personal data collected will be kept for as long as it is necessary for the provision of the services or as required by law. After the end of this period, the data will be deleted or anonymized, as applicable.

16. Application Updates

ProjetoX may, at its discretion, provide updates and improvements to the application. You agree to accept these updates in order to continue using the application. Failure to accept updates may result in limited functionality or the inability to use the application.

In certain updates, features of the application may be modified or removed. ProjetoX does not guarantee that all functions will remain available in future versions.

17. Modifications to the Application

We reserve the right to modify, suspend, or discontinue the app (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the application.

When possible, we will notify users in advance of significant modifications or discontinuation of functions or the application.

18. Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms of Use or if we believe that your conduct harms the App or other users. Upon termination, you must cease all use of the app.

In the event of termination, the user may be held liable for any actions that have caused damage to ProjetoX, its partners or other users.

19. Responsibility for Connection and Operation of the Device

The functions of the BUSCA PEÇAS application require an active internet connection, either via Wi-Fi or mobile data. ProjetoX is not responsible for the malfunction of the app if you do not have a proper internet connection or if your device is experiencing problems, such as running out of battery. If you use the app outside of Wi-Fi areas, you will be responsible for mobile data costs in accordance with your agreement with your mobile service provider. In addition, in roaming areas, you may incur additional charges, and by using the app, you agree that you are responsible for these costs.

20. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the app will be available continuously, error-free, or that it will be secure.

This disclaimer of warranties also applies to any support or assistance service offered by ProjetoX, which is provided "as is" and without additional warranties.

21. Limitation of Liability

Our maximum liability with respect to any claim related to your use of the application will be limited to the amount you paid, if any, to use the application, except in cases of willful misconduct or bad faith.

ProjetoX is not responsible for any problem arising from the use of third-party services or for failures caused by service providers used in the application.

ProjetoX shall not be liable for any indirect, consequential, incidental, or punitive loss arising out of the use of or inability to use the application, third-party services, or failures of service providers.

22. Entire Agreement

These Terms of Use constitute the entire agreement between you and ProjetoX regarding your use of the application, superseding any prior agreements or understandings, oral or written.

23. Indemnification

You agree to indemnify and hold harmless ProjetoX, the developer of the BUSCA PEÇAS application, and its directors, employees and partners from any liability for losses, damages, liabilities, claims or demands, including attorneys' fees, made by third parties due to the use of the application or the violation of these Terms of Use.

You agree to indemnify and hold ProjetoX and its employees harmless from any claims, losses, damages, liabilities, or costs (including attorneys' fees) arising out of your use of the application or your violation of these Terms of Use.

24. Changes to These Terms

We may revise these Terms of Use at any time. The changes will take effect after the new Terms of Use are posted in the app. We encourage you to review these terms periodically. Your continued use of the app after the changes will be deemed acceptance of the new terms.

Whenever there are significant changes to these Terms of Use, we commit to notifying users through direct communication, such as email or in-app notification.

ProjetoX reserves the right to update its data collection and processing practices as new legal regulations on data protection are introduced, to ensure ongoing compliance.a.

25. General Provisions

25.1. Governing Law

These Terms of Use are governed by the laws of Brazil, including the General Data Protection Law (LGPD), without regard to its conflicts of law provisions.

25.2. Dispute Resolution

Any dispute or claim arising out of or related to these Terms of Use will be resolved exclusively in the competent courts of Curitiba/PR, and you consent to the jurisdiction and venue of these courts, with ProjetoX as the party responsible for the development and maintenance of the application.

Any dispute arising out of these Terms of Use must be communicated within 30 days of becoming aware of the cause of the dispute.
